Strayker’s Hip Recall Settlement May Top $1 Billion

Stryker Corporation, one of the worlds leading manufacturer of hip and neck replacement, has come to a settlement with thousands of patients who were injured by their hip implant devices. In 2009, the company introduced what it claimed were state of the art hip replacement devices named Rejuvenate and ABG II.

The devices were touted as long lasting and very safe. The reality of the devices turned out to be much different the companys marketing assertions. Thousands of patients who received the devices were forced to undergo additional surgeries to fix corroded and malfunctioning hip devices that released metal ions into the blood streams of patients.

Terms of the Settlement

Under the settlement, Stryker will provide an initial payment of $300,000 to every patient who received either a Rejuvenate or ABG II hip system and who received follow-up surgery to remove or replace the hip systems on or before November 3, 2014.

Though $300,000 is a floor it is not a ceiling. While all individuals who received the revision surgery to fix the hip replacement services by Nov. 3, will receive at least $300,000, they may receive more money depending on the injuries they suffered.

Additional payments will be provided to injured patients who experienced extraordinary medical injuries, or who underwent multiple surgeries or who may have experienced medical infections. The kinds of potential complications that could lead to additional payments will be determined on a case by case basis.

The Stryker case settlement is an unlimited settlement. This means that the corporation is not capping their monetary liability under the terms of the settlement. Total payments may exceed $1 billion.
